Terms & Conditions
Rules for using Kitonga Online as a guest or MikroTik owner.
Agreement
These Terms & Conditions (“Terms”) govern use of Kitonga Online, the guest Wi‑Fi portal, payment flow, and owner dashboard. By creating an owner account, paying for a package, or using the hotspot through our portal, you agree to these Terms and our Privacy Policy.
The service
Kitonga Online helps MikroTik hotspot owners sell time-limited guest Wi‑Fi and manage packages, payments, and connected devices. We are not a mobile network operator and do not guarantee uninterrupted internet from the owner’s ISP or radio equipment.
Guest users
When you buy Wi‑Fi access:
- You pay for access according to the package shown (duration, device limits, price).
- Access is granted after successful payment confirmation from the payment partner.
- You must use the service lawfully and not attempt to bypass the hotspot, share credentials in ways that violate the package rules, or attack the network.
- By paying, you confirm the phone number and device information submitted are accurate enough to authorize your session.
Owners / providers
If you register as an owner:
- You are responsible for your MikroTik configuration, local network, and lawful operation of the hotspot at your site.
- You must keep RouterOS credentials and API keys secure and only use Kitonga tooling as documented.
- Package prices and features you publish must be accurate; you are responsible for guest expectations at your location.
- You must not use the platform for fraud, spam, or illegal content distribution.
- If you use the dashboard to sell guest Wi‑Fi and receive collected payments through our payment flow, you agree to the owner settlement and platform fee in section 5 below.
Owner settlements and platform fee
If you register as an owner and use Kitonga Online to manage your hotspot and collect guest payments through the platform, the following applies when you request payout or settlement of those collected payments:
- Kitonga Online (the platform operator) may retain a service fee of up to ten percent (10%) of the gross amount of payments successfully collected through your account for access sold on your MikroTik(s), unless we agree a different rate with you in writing.
- The fee covers use of the portal, payment integration, dashboard, and related platform services. It is deducted before or at the time of settlement, as shown in your dashboard or payout statement where available.
- You remain responsible for your own taxes, licenses, and compliance with local law on money you receive from guest sales.
- Payout timing, minimum amounts, and payment method may depend on our payment partners and operational rules; we will communicate material changes through the dashboard or these Terms.
- Disputes about guest charges are handled under section 6; the platform fee applies to successfully confirmed guest payments unless we reverse a transaction in accordance with our refund rules.
Guest payments and refunds
Guest payments are processed by mobile-money / payment partners (M‑Pesa, Airtel Money, Mixx by Yas, HaloPesa). The following refund policy applies:
- Access is granted only after the payment partner confirms your transaction. Failed or timed-out payments may not open Wi‑Fi — you can retry or contact the site owner.
- If you are charged but do not receive access, contact support or the hotspot owner within 48 hours with the phone number used and approximate payment time, and we will investigate with the payment partner.
- Confirmed failed charges are reversed by your mobile-money provider according to its rules; where a reversal is required from us, it is sent to the originating phone number.
- Packages that have been successfully activated are generally non-refundable once the session has started, since access is consumed immediately.
- Refund requests are handled case-by-case with the hotspot owner and, where applicable, the payment provider’s rules.
Availability
We aim for reliable uptime but provide the service “as available.” Outages may occur due to maintenance, network issues, or third-party payment providers. We are not liable for lost sales or guest inconvenience caused by factors outside our reasonable control.
Intellectual property
The Kitonga Online name, branding, and software remain our property or our licensors’. You may not copy, reverse engineer, or resell the platform except as expressly allowed.
Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages (including lost profits or data) arising from use of the hotspot or dashboard. Our total liability for a claim relating to the service is limited to the fees you paid to us for the service in the three months before the claim (or zero if you paid us nothing).
Suspension
We may suspend or terminate accounts or access that violate these Terms, harm the service, or create legal risk. Owners remain responsible for guests already authorized on their MikroTik until they revoke access locally.
Changes
We may update these Terms. Material changes will be reflected by the “Last updated” date. Continued use after changes constitutes acceptance where allowed by law.
